1. Introduction
Welcome to MX Tracks ("we", "us", "our"), operated via the website themxtracks.com. These Terms of Service ("Terms") govern your access to and use of the MX Tracks platform, including all content, functionality, and services offered. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
2. Description of Service
MX Tracks is a directory platform that allows users to discover, review, and share information about motocross tracks and motoclubs across Italy. The platform provides track listings, rider reviews, contact information, maps, photos, and event listings. MX Tracks does not operate, manage, or own any of the tracks or motoclubs listed on the platform.
3. User Accounts
Certain features of the platform may require you to create an account or sign in via Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. User-Generated Content
Users may submit content including reviews, ratings, photos, and track information ("User Content"). By submitting User Content, you grant MX Tracks a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, reproduce, modify, and distribute your content on the platform. You represent that you own or have the necessary rights to submit such content and that it does not infringe on any third party's intellectual property or privacy rights. All reviews are subject to moderation before publication.
5. Prohibited Conduct
You agree not to: submit false, misleading, or inaccurate track or review information; use the platform for any unlawful purpose; harass, abuse, or threaten other users; attempt to gain unauthorised access to the platform or its systems; upload viruses, malware, or other harmful code; scrape, crawl, or use automated tools to extract data from the platform without our prior written consent; impersonate any person or entity.
6. Intellectual Property
All content on the platform that is not User Content — including but not limited to the platform design, logo, text, graphics, and software — is the property of MX Tracks or its licensors and is protected by copyright and other intellectual property laws. Map data is provided by OpenStreetMap contributors under the Open Database Licence.
7. Disclaimer
MX Tracks is a directory service. We do not guarantee the accuracy, completeness, or reliability of any track information, reviews, or user-submitted content. Track conditions, opening hours, pricing, and facilities may change without notice. Always verify information directly with the track or motoclub before visiting. MX Tracks is not responsible for any injury, loss, or damage arising from the use of tracks listed on the platform.
8. Limitation of Liability
To the maximum extent permitted by applicable law, MX Tracks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.
9. Third-Party Services
The platform integrates with third-party services including Supabase (authentication and data storage), PostHog (analytics), Vercel (hosting and analytics), Resend (email), Upstash (rate limiting), Cloudflare (security), OpenStreetMap/Leaflet (maps), and Axeptio (cookie consent). Your use of these services is subject to their respective terms and privacy policies. MX Tracks is not responsible for third-party service availability or practices.
10. Termination
We reserve the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Italian Republic. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.
